Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that are causing or likely to cause death or serious physical harm to employees who were exposed to the hazard of being crushed-by a forklift during a tip-over event while operating powered industrial trucks at Allen Canning Company without wearing seatbelts. The employer violated this section of the Act on or about September 12, 2003, throughout the facility when forklifts identified as Nos.6, 10, 111, 114, 118, 119, 131, 134 and 5-18a, were not retrofitted with seatbelts. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that powered industrial trucks are retrofitted with seatbelts.
