Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about July 6, 2004, at approximately 3:30am, the Thomas Drilling Rig #1 collapsed due to the combination of the physical condition of the rig which had not been inspected adequately to identify weakened welds, and stress fractures and the loading of the rig and high winds on that day. Among other methods, one feasible and acceptable method to correct the hazard is to inspect and maintain the rig in a safe condition in accordance with American Petroleum Institute Guidelines API 54-1992, Section 8.2.1.n
