North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: a)being struck by or caught in between the roll over protection and the ground in the event the employee falls or gets thrown off. The employee operating the Lull Highlander Two Forklift, model 844C-42, was exposed to being caught in between/crushed from not using the installed seat belts. Among other methods, one feasible and acceptable abatement method to correct this hazard is to train/certify and inspect employees on wearing seatbelts installed by the manufacturer of the Lull Highlander Two Forklift.r
