Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment that was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that operators failed to use seat belts when operating industrial trucks: (a) On 20 Aug. 2004, The SKY TRAK, Model 8400, serial number P6146, rough terrain powered industrial truck (forklift) was operated without the seat belt being used by the operator. "AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO REQUIRE ALL EMPLOYEES USE SEATBELTS WHEN OPERATING A FORKLIFT." Note: Abatement certification required for this item.
