Text For Citation: 01 Item/Group: 001 Hazard: UNAPEQUIP
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazard of being backed over by motor vehicles having a restricted view to the rear: (a)U.S. Interstate 90 in the vicinity of mile marker # 46: On or about May 24, 2004, and at times prior thereto, employees were exposed to the hazard of being backed over by the Kenworth water truck (vin # 2576393/Montana License # S10960), where adequate measures were not taken to warn personnel on the ground that the equipment was backing up or to ensure that equipment could be backed up safely. Among other methods, one feasible and acceptable abatement method to correct this hazard is to install and properly maintain a functioning back up alarm or use a observer/signal person(s) to signal to the operator when it is safe to back up. Notes: (1)Abatement certification and supporting documentation are required for this item. (2)Abatement certification for this item will require an inspection of all trucks and equipment with similar hazards and taking corrective action if necessary, where back up alarms are used in lieu of observers/signal person(s).
