Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by high pressure cleaning wand while working in the pan cleaning bay: (A)Plant floor: on April 20, 2004, and at times prior to, a high pressure spray wand, capable of operating up to 3000 psi, had a manually-actuated control (deadman control) that had been over ridden and was not functional. ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement method to correct this hazard is to require, ( as found in UL 1776, High- Pressure Cleaning Machines), the following: 1. Manually operated controls (deadman controls), with the actuator (trigger) located or guarded to prevent unintentional operation and capable of shutting off water flow when released. Note: Abatement certification required for this item.
