North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: fire hazards, pinch points, and/or being caught in/struck by components of passenger and freight carrying elevators: a)facility - Shipping freight elevator, a three-inch gap between the sill and door panel was present. Note: allowed one-inch in 110.12* b)facility - Shipping freight elevator, the bi-parting panels had a three-inch gap. Note: allowed two-inches in 110.12* c)facility - Shipping freight elevator, safety reverse/reopening device not functioning. Note: required by Rule 112.5* d)facility - Shipping freight elevator, fluorescent lights were missing guards. Note: required in 204.1h* and 204.7d* e)facility - Bakery freight elevator, the door sill and door panels were rubbing indicating lack of clearance for door. Note: required in 110.12* f)facility - Bakery freight elevator, the elevator car had several large holes and bends/depressions in the metal car walls. Note: large holes not allowed by 204.2b* and 204.3a* g)facility - Office passenger hydraulic elevator, the oil pipe in the hoistway was without fire resistant insulation. Note: required in 100.1a(3)* h)facility - Office passenger hydraulic elevators, excess oil was present in the drip pans. Note: amount limited in 1206.5 *Reference ASME A17.1-1996 - Safety Code for Elevators and Escalators Among other methods, feasible and acceptable abatement methods to correct the hazard are as follows: 1) Designate and fully train maintenance person(s) to inspect all elevators at a regular, tracked interval; document the elevator inspection on a checklist or similar form that records acceptable or adverse conditions; immediately perform minor repairs and schedule major repairs when deficiencies are found during the inspection or reported by maintenance personnel, other employees, or contractors. The designated person(s) has authorization and management support to perform such duties, up to and including taking theelevator out of service, and serves as the contact person for outside elevator contractors and elevator inspectors. AND/OR 2) Hire/contract an elevator service company to perform all of the above elements. The contractor's work would be 100supervised by a designated Lance employee.d
