Minn. Stat. 182.653 subd. 2: The employer did not furnish to each employee, conditions of employment and a place of employment free from recognized hazards which caused or were likely to cause death or serious injury to employees: An employee of Wenzel Plumbing was riding in the work platform of a Lull forklift owned and operated by an employee of Tappe Construction. The employee had no fall protection on and the front of the platform was not guarded, which exposed him to fall hazards and the potential of being struck by the Lull forklift.
