Text For Citation: 01 Item/Group: 001 Hazard: HEAT
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire/explosion hazard: a) On or about 2/20/03, area A on west side of bldg., at the Lancaster High School construction site, Lancaster, NY: Employees were exposed to a fire/explosion hazard because a 1000 gal. "above ground" container of propane located outside the building under construction, was being used to fuel temporary heaters inside the building. The minimum distance between this container and the masonry wall of the building was only 8 ft. 9 inches. Among others, a feasible method to eliminate or materially reduce this hazard is to move the propane container, so that all parts of the container are at least 10 ft. away from the wall of the building. This would comply with NFPA code 58, Table 3-2.2.2. ABATEMENT CERTIFICATION REQUIREDATION
