Text For Citation: 01 Item/Group: 001 Hazard: BURNS
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: fire, explosion, and burn hazards due to potential contact with liquid propane. a) Able Energy worksite - 38 Diller Ave, Newton, N.J.; The employer failed to prohibit the transfers of liquid propane from a transport tanker cargo truck to the cargo tanks of "Bobtail" trucks. Employees were exposed to fire/explosion hazards along with potential burns hazards due to potential contact with liquid propane itself. * Among other methods one feasible and acceptable abatement method to correct this hazard is to prohibit the transfer of liquid propane from cargo tanks as required by the New Jersey Administrative Code, Title 5, Department of Community Affairs, Chapter 18, Section 3.3, paragraph (o)1. Violation occurred on or about 3/14/2003.
