Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a masonry wall collapse resulting in crushing injuries: a) On or about May 29, 2003, employees were exposed to crushing injuries when a masonry block wall collapsed due to wind speeds exceeding 20 miles per hour. This requirement can be found in the Council for Masonry Construction's Standard Practice for Bracing Masonry Walls During Construction, Section 1.2.1.1.
