Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment free from recognized hazards that were causing, or likely to cause, death or serious physical harm to employees, in that on or about October 29, 2004, the employer did not provide adequate safeguards or protection from the recognized hazard of being struck by and caught in/between an automated overhead gantry and the upper part of the laser load frame. On or about October 29, 2004, at Cooper B-Line, two employees were working at the Cincinnati CL-707 CO2 laser #50243. The employees were examining a piece of recently cut sheet metal, when they were struck from behind by the overhead gantry and caught in/between the upper part of the load frame of the laser. Among other methods, some feasible and acceptable methods to correct this hazard are: Safeguarding devices such as presence-sensing devices, interlock barriers, perimeter guarding, safety light curtains, awareness barriers, and awareness signals. These devices shall be designed and constructed to prevent the operator or any other person from having any part of his body in contact with moving machinery.
