Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. The employee operating a powered industrial truck without using a seat belt was exposed to the hazard of injury from tipover accidents that seat belts are designed to address. On or about March 8, 2004, at 1401 E. Washington, an employee was exposed to the hazard of being caught between a forklift and the ground due to the forklift operator not being required to wear the seat belts provided on the LP Daewoo Forklift #D-633127. Among other methods, one feasible and acceptable abatement method to correct this hazard is to require the use of the seat belts provided on the forklifts in accordance with ASME/ANSI B56.1, Safety Standards for Low Lift and High Lift Trucks.ds
