Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) hazards created by the use of elevated work platforms which were not designed, constructed and/or used in accordance with the acceptable requirements of the American National Safety Standard for Rough Terrain Forklift Trucks, ASME B56.6-1992. The personnel platform and its use did not meet the design requirements of that standard in the following areas: (1) Modifications and additions, such as a personnel platform, did not have the manufacturer's prior written approval. (2) The forklift truck controls were not in neutral with the parking brake set. (3) A trained operator was not in position to control the rough terrain forklift. These conditions existed when an employee was working on a residential building from a platform attached to the forks of a rough terrain forklift. Among other methods, one feasible and acceptable abatement method to correct these hazards is to assure that the design, manufacture and use of all attachments for Rough Terrain Forklift Trucks are in accordance with the most current American National Standard, B56.6 (presently B56.6-1992), and/or has the prior approval of the lift truck manufacturer.
