Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by or caught between automotive vehicles: a) Location - Recon Dept.: On or about January 22, 2003, employees were exposed to bodily injury from moving automotive vehicles while reconditioning them for auction and resale. Among other methods, feasible means of abatement would be to: 1. Enforcement of employer requirement of engines being turned off while at each station. 2. Mechanically push or pull vehicles from station to station. 3. Increase the required distance between each parked vehicle and each station.
