Section 5(a)(1) of the Occupational Safety and Health Act of 1970: Throughout the facilities in the vicinity of the job site located at 701 N. 108th Circle, Omaha, NE - The employer failed to furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The hazard of being crushed or thrown by the fork lifts being operated without seat belts. Employees face the potential of being thrown from a fork truck due to the lack of seat belt usage observed on the job site. Among other methods, one feasible and acceptable method to control the hazard is to: a) Develop and implement written procedures as per AMSE Standard B56.1-2000, requiring operators of powered industrial trucks to wear seat belts provided when operating the vehicles. b) Develop and implement a disciplinary action and procedures to ensure that employees wear seat belts while operating these vehicles. c) Review and audit the company's training program and trainers to ensure that information being presented is true and factual as per the latest regulatory directives and reflects OSHA policy and generally accepted industry practices such as AMSE Standard B56.1-2000. Abatement certification is required for this violation. The abatement certification sheet is enclosed with the citations.
