Section 5(a)(1) of the Occupational safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a. On or about May 27, 2003, at the addressed jobsite, the non-functioning reverse alarm on the CAT 930 front-end loader that operates in reverse in the "Yard" where employees work, exposes employees to "struck-by" hazards. Feasible and acceptable abatement methods include, but are not limited to; ensuring that the back up alarms are operating, and/or to comply with the "Equipment Manufacturer's Institute Guidelines" and check the warning devices prior to operating the equipment.
