Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment which was free from recognized hazards that were likely to cause death or serious physical harm to employees in that employees performing an inspection of a bridge were exposed to a drowning hazard. a. On or about April 10, 2003, employees were inspecting the underside of the Division Street bridge from the basket of a UB 60 series Underbridge Machine. A passing barge struck the boom of the machine and the employees fell in to the water below.
