Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and other serious hazards from operation of an aerial platform lift being operated by persons who failed to maintain a safe distance from stationary objects. a. On or about February 6, 2003, an employee was fatally injured while driving a JLG articulating boom lift (serial #0300016967) inside of Building #50 as he was caught between an overhead steel beam and the platform control console. One feasible method to abate this hazard, among others, is to assure that all employees responsible per their job description, safely and properly operate this type of equipment as per MANUAL OF RESPONSIBILITIES for Dealers, Owners, Uses, Operators, Lessors and Lessees of ANSI/SIA A92.5-1992 Boom-Supported Elevating Work Platforms.
