29 CFR 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Big Mountain Construction Site: As the controlling employer, Bowden Montana Development, LLC, did not ensure it's sub-contractor, Great Northern Custom Homes, protected there employees from the hazards associated with a fall of approximately 20 feet while using a man basket which was not provided with a mid-rail in the guard rail system as per ASME B56.6-2002. (b) Big Mountain Construction Site: As the controlling employer, Bowden Montana Development, LLC, did not ensure it's sub-contractor, Great Northern Custom Homes, protected there employees from the hazards associated with a fall of approximately 20 feet while working in a man basket which was not secured to the forklift as per ASME B56.6- 2002.
