Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by material: On or about December 28, 2004, employees of TNT Logistics North America Inc. were exposed to the hazard of being struck by a steel safety pole while attempting to pry the pole loose from its bolted foundation using the fork of a Nissan Forklift, Model Number CWP02L25S, Serial Number 9C3032. Among other methods, one feasible and acceptable abatement method to correct this hazard is to: a)ensure the powered industrial truck is operated safely in accordance with ASME B56.1-2000, American National Standard Safety Standard for Low Lift and High Lift Trucks, Section 5, Operating Safety Rules and Practices.
