Minn. Stat. 182.653 subd. 2: The employer did not furnish to each employee, conditions of employment and a place of employment free from recognized hazards which caused or were likely to cause death or serious injury to employees; specifically: The supporting means or structure to which four hoists, including a portable manually lever operated chain hoist, were attached, but had not been designed, constructed, or used in a manner that would safely and securely support the load consisting of the upper frame of the car wash rack. This overall structure was not stable and was not secured to prevent the lateral movement and collapse that resulted in fatal injuries to an employee on November 19, 2002.
