Minn. Stat. 182.653 subd. 2: The employer did not furnish to each employee, conditions of employment and a place of employment free from recognized hazards which caused or were likely to cause death or serious injury to employees: A Wagner 16 inch electric chainsaw was used at the south end of the shop for cutting 4x4's used as dunnage for shipping structural steel parts or product. The cutting chain was not equipped with a chain brake, and leg protection constructed with cut resistant material (e.g. ballistic nylon) was not provided and its use ensured by the employer.
