Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being trapped under the overhead protection of the lift in the event of a roll over: (a) On or about January 8, 2004 - The operator of the Caterpillar TH63 rough terrain fork lift was not using the installed seat belt. One acceptable means of abatement is for the operator to wear the manufacturer's seat belt that was installed on the fork lift. ABATEMENT CERTIFICATION AND DOCUMENTATION NOT REQUIRED
