Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: Or, in the alternative: 29 CFR 1910.212(a)(1): Machine guarding was not provided to protect operator(s) and other employees from hazard(s) created by inrunning nips and moving/rotating parts: a)Waste Water Treatment Plant: On or About 6/3/03 Employees working in the basement area below the two sludge presses were exposed in inrunning nips and the Emergency cable stops would not work. Among others, one feasible means of abating the hazard includes: Installation of guarding at inrunning nips along the conveyor or the installation of emergency cable stops and the testing and maintenance of the emergency Stop Cable. Which meet the requirements of ANSI/ASME B20.1-1987, Safety Standard For Conveyors and Related Equipment.
