Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The hazard of being crushed by overturning Tractor Loader Backhoe. a) Establishment, 293 Benedict Avenue, Tarrytown N.Y. 10591: Employees operating a John Deere Tractor Loader Backhoe 110, were exposed to the hazard of being struck by overturning Tractor Loader Backhoe while Tractor Loader Backhoe is being operated without the seat belt being worn, on or about 04/25/03. Among other feasible methods, one feasible and acceptable abatement method to correct this hazard is to... 1.Ensure employees follow the Operators Manual for the John Deere Tractor Loader Backhoe 110, Safety Instruction's, Section 3, recommendations for safe operation of the Tractor Loader Backhoe. These recommendations include, but are not limited to, "AVOID CRUSHING. Do not jump if machine tips. USE SEAT BELT". NOTE: Because abatement of this violation is already documented in the inspection case file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.
