North Carolina General Statute 95-129(01) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were likely to cause death or serious physical harm to employees, in that employees were exposed to unsafe traffic control procedures while dump trucks were being backed up to unload hot asphalt to paving machine without the use of a guideperson to ensure employees and other personnel were clear of backing trucks. a) site - Dump Truck, GMC, dual axle: On or about October 21, 2002, a dump truck hauling hot asphalt was being backed up to the paving machine without a guideperson being used to ensure that all workers were clear of the path of the truck. Reference - American National Standard for Construction and Demolition, ANSI A10.17-1997, page 2, section 3.3.1 b) site - Dump Truck, GMC, dual axle: On or about October 21, 2002, guideperson was not being used/available to ensure workers were clear of all backing vehicles. Reference - American National Standard for Construction and Demolition, ANSI A10.17-1997, page 2, section 3.3.1.3 c) site - Dump Truck, GMC, dual axle: On or about October 21, 2002, vehicle was not approaching the paver in a slow and cautious manner.
