Text For Citation: 01 Item/Group: 001 Hazard: FALLING

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were riding on the steps of a backhoe. An S&R Construction employee was observed riding a Case 580 backhoe standing on its frame and directly in front of the rear tire while traveling approximately 1/2 mile on the edge of Jacaranda Blvd in Venice, Fl. While turning off the road, the backhoe was observed bouncing around until coming to a stop where the employees were taking a break. Abatement would be to comply with the Case Manufacturer's Operators Manual where it specifically states "DO NOT ALLOW OTHER PERSONS TO RIDE ON THE MACHINE. OTHER PERSONS CAN FALL OR CAN CAUSE AN ACCIDENT. THIS IS A ONE PERSON MACHINE WITH ONE OPERATOR'S SEAT."OR'S
