Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of operating powered industrial trucks without using manufacturer installed seat belts. Within the confines of this facility: Employees who operated fork lifts at this facility failed to use seat belts during their normal work activities. Seat belts were provided by the manufacturer on many of the fifteen (15) fork lifts used at this facility. Fork lift operators normally load and unload transport trucks and are exposed to tip over hazards. Recognition of the hazard of forklift tip over and the need for operators to use an operator restraint system is evidenced by certain requirements in the more current version of ANSI B56.1 consensus standard for powered industrial trucks, and ASME B56.1-2000 - Safety Standard for Low Lift and High Lift Trucks. Abatement certification is required for this violation. The abatement certification sheet is enclosed with the citations.ion
