T.C.A. 50-3-105(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: In that the 15 ft. deep open pit area within the Solid Waste Department Warehouse was not protected by a barrier or other protective means to prevent employees operating a powered industrial truck from exceeding the edge of the warehouse floor and falling into the open pit area. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to install bumper guards near the end of the floor prior to the pit area. Another feasible and acceptable abatement method would be to install floor plates which, when depressed from the weight of the powered industrial truck, an auditory signal alerts the driver to discontinue their forward progression towards the open pit.
