Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of associated with not wearing seatbelts when operating powered industrial trucks: (a)Job Site: On October 17, 2002 and at times prior thereto, employees operated power industrial trucks without wearing seatbelts. AMONGST OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO REQUIRE THE USE OF SEAT BELTS WHEN OPERATING FORKLIFTS (POWERED INDUSTRIAL TRUCKS) THROUGHOUT THE ESTABLISHMENT AS REQUIRED BY ANSI/AMSE B56.1, PARAGRAPH 5.3.19. Note: Abatement certification and supporting documentation are required for this item.
