Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of flying parts: (a)Fabrication Shop: On August 7, 2002 and at time prior thereto, a tongue guard was not present on the shop-made pedestal grinder. (b)Diesel Shop: On August 7, 2002, and at times prior thereto, a tongue guard was not present on the Stellar bench grinder, model BG-6, serial number 10109. (c)Diesel Shop: On August 7, 2002, and at times prior thereto, a tongue guard was not present on the AB Quality Grinder, Simplot equipment number 00961, located on the east side of the building. (d) Gas Shop: On August 7, 2002, and at times prior thereto, tongue guards were not present for the two wheels on the shop-made grinder. (e)Tractor Shop: On August 7, 2002, and at times prior thereto, a tongue guard as present on the grinder. (f)Mill Shop: On August 7, 2002, and at times prior thereto, a tongue guard was not present on the shop-made grinder. (g) Deleted. Note: Abatement certification required for this item. AMONGST OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO EQUIP THE GRINDERS WITH ADJUSTABLE TONGUE GUARDS WHICH CAN BE ADJUSTED TO THE CONSTANTLY DECREASING DIAMETER OF THE WHEEL AND KEPT ADJUSTED SO THAT THE DISTANCE BETWEEN THE WHEEL PERIPHERY AND THE ADJUSTABLE TONGUE SHALL NEVER EXCEED ONE-FOURTH INCH AS REQUIRED BY ANSI B7.1-1970. ALSO EQUIP THE BIT SHARPENER WITH A WORK REST ADJUST TO WITHIN ONE-EIGHTH INCH OF THE WHEEL PERIPHERY AS REQUIRED BY ANSI B7.1-1970.
