Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment which was free from recognized hazards that were causing or are likely to cause death or serious physical harm to employees; in that an employee was permitted to ride on the step above the tracks of a JOHN DEERE, Model 270LC, Hydraulic Excavator, exposing the employee to the hazard of being struck by, crushed by, or thrown off the hydraulic excavator: (a) White Drain Project: On 25 July 2002, the foreman, who was the operator, allowed a person to stand and ride on the superstructure- step of the excavator thus exposing the person to the hazard of being struck by and/or crushed by a hydraulic excavator. The person was riding on the step above the tracks of a JOHN DEERE, Model 450C LC, PIN: FF540CXR09112, a hydraulic excavator, while the excavator was digging an excavation and moving. Among others, one feasible and useful abatement method to correct this hazard is to: Follow the requirements of the Operator's Manual for the John Deere, Model 450C LC Excavator.
