Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employee(s) were exposed to the hazard of. a)Plant Number 3: On October 8, 2002, an igloo-shaped kiln collapsed after steel bands were cut off of the exterior of the structure. An engineering survey was not performed prior to the removal of the steel bands to determine the potential for collapse.
