Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Frisco water tower construction was located at 12300 CR 22 (intersection of County Road 22 and County Road 71), Frisco, Texas. On or about Tuesday, November 26, 2002, before employees began repositioning the choker on the derrick boom, the employer did not ensure that the boom was secured to prevent displacement. At least three employees were exposed to the hazard of being struck-by and/or crushed-by the boom.
