Text For Citation: 01 Item/Group: 001 Hazard: UNAPOPPROC
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: At Encore Wells located at 1221 South Lamar, Dallas, Texas 75215. On or about September 28, 2002, employees who were attempting to straighten out a 32-foot dump trailer using a 4800 Link belt excavator and a Cat 983 track loader were exposed to hazards resulting in multiple broken bones, internal injuries, and possible death. Among other methods, one feasible and acceptable method to control the hazard is to utilize the 4800 Link belt excavator and 983 track loader for only those purposes for which they were designed.
