NYSLL Article 2, Section 27a (3a)(1): The employer did not furnish to each of its employees, employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to its employees and which will provide reasonable and adequate protection to the lives, safety or health of its employees; (a) The employer did not furnish to each of its employees, employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to the hazard of being infected with Mycobacterium tuberculosis through unprotected contact with patients who were infectious or suspected to be infectious with tuberculosis (TB) in that: no medical surveillance and no education or training on TB was performed. In applying this paragraph, fundamental distinctions between private and public sector employment have been recognized. Reasonable and adequate methods for reducing this hazard, as recommended by the CDC, include, but are not limited to: (1) Medical surveillance by offering the Mantoux skin tests; (2) Provide education and training on tuberculosis (TB). At the Ruby FD, the district did not offer the EMT's the Mantoux skin tests or provide education and training on TB. NOTE: Training shall include mode of TB transmission, its sign and symptoms, medical surveillance and therapy, and site specific protocols including the purpose and proper use of controls. The training shall be provided to all current EMT's and new members upon hiring.
