Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards due to lack of training on how to move rail cars and close clearances created by the rail car and the frame of the excavator: (a) Matt Canestrale Contracting, Rail Car Cleaning Area: On or about 2/3/03, an employee was drifting a group of rail cars into position when he was pinched between the car the A-Frame used to support the Cat excavator. Among other methods, feasible and acceptable abatement to correct this hazard is to implement a safety training program on the proper way to move rail cars. This shall include training operators/brakemen to face the direction of travel, identify and label all close clearances, and to avoid the pinch points created by the close clearance between the A-Frame and the rail cars.
