Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Hancock Road jobsite, Harmar Twp., PA; On or about March 8, 2002, the 1988 Mack Trucks, Inc. garbage truck (Truck #1) was not properly maintained. The back-up warning alarm was malfunctioning when the vehicle was put into reverse. The vehicle was not taken out of service before the back-up warning alarm was repaired. (b) Hancock Road jobsite, Harmar Twp., PA; On or about March 8, 2002, before the 1988 Mack Trucks, Inc. garbage truck (Truck #1) was put into reverse, it was not ensured that the area behind the vehicle was clear and that the locations of all the employees were known.
