Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: (a) Employees were exposed to being struck by or crushed beneath slipping or falling vehicles due to defects including missing or inoperable safety latch(es), makeshift safety latch handle/actuator and the bowing/deflection of the side rails/uprights on automotive lifts in that preventative maintenance inspections were not performed for the automobile lifts and lifts with defects were not removed from service. Among other methods, one feasible and acceptable method for abating this condition would be instituting a program of daily and periodic inspections to ensure lifts are in compliance with the American National Standard Institute/Automotive Lift Institute, ANSI/ALI ALOIM-2000, for the Safety Requirements for Operation, Inspection and Maintenance of automotive lifts and removal of lifts with defects from service.
