Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that paper makers are exposed to a engulfment hazard causing thermal burns and struck by hazards from falling materials (paper broke). (a) On February 17, 2002, an employee was fatally injured while cleaning up broke underthe dryer sections of the number one paper machine. The victim was cleaning- up paper broke underneath the dryer section of the paper machine when the kraft paper (broke), traveling through the paper machine at speeds of 2,181 feet per minute and between 120-130 degrees fahrenheit broke and fell to the basement floor below covering the victim with the hot and heavy broke. Among others, one feasible and acceptable method to correct this hazard is to employ engineering methods to remove the broke such as utilizing high pressure water to remove the broke and prohibit employees from being under the machine while it is running.
