Minn. Stat. 182.653 subd. 2: The employer did not furnish to each employee, conditions of employment and a place of employment free from recognized hazards which caused or were likely to cause death or serious injury to employees: On February 2, 2002, an employee working from a JLG 800AJ rough terrain aerial lift was not using a safety harness and lanyard, which exposed the employee to fall hazards in excess of 50 feet.
