Minn. Stat. 182.653 subd. 2: The employer did not furnish to each employee, conditions of employment and a place of employment free from recognized hazards which caused or were likely to cause death or serious injury to employees. Specifically, on the 10 ft. (no-name) squaring shear in the shop: a)An extension spring and a rubber/ poly-cord tiedown strap were used to provide tension on the foot-treadle. The pedal/ treadle return spring was not of the compression type, operating on a rod or guided within a hole or tube, and designed to prevent interleaving of spring coils in event of breakage. b)The employer had not acted responsibly to establish and ensure the use of safe procedures for the care and maintenance of the shear. c)A training program and procedures had not been developed and implemented to ensure that maintenance personnel were instructed in proper and safe maintenance procedures. d)A systematic program of periodic and regular inspection of shear production systems to ensure that all their parts, auxiliary equipment, and safeguarding were in safe operating condition and adjustment.
