Section 88.4 Code of Iowa (2002) 88.4: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a)County Maintenance Areas/Tractors with ROPS - Employees driving tractors with Roll Over Protection Structures (ROPS), were not required to use seat belts exposing employees to injuries from un-intentionally exiting the operator's seat and therefore the safety zone provided by the ROPS. The Ford Operators Manual 5600-6600-7600 states ALWAYS use your seat belt when the PROPS is installed-seat belts save lives when they are used. Serious and life-threatening injuries including contusions, abrasions, and compression injuries could occur when struck by the ROPS or the tractor. Among other methods, one feasible and acceptable abatment method to correct this hazard is to require the use of seat belts on all tractors equipped with ROPS.
