Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the rotating parts on the drive shaft of a Power Take-off which could cause fractures, crushing injuries and/or death: On or about 12/18/01 A) At the rear of the building at 2160 Lafayette Road, Falconer, NY. The drive shaft and Universal Joint used as part of the hole digging apparatus, A John Deere 5410 Tractor, Power Take-off (PTO), and auger, was not guarded to prevent a person from getting caught up in the rotating parts. Among other methods, one feasible and acceptable method to reduce this hazard is install a properly designed shield which would prevent employees and their clothing from getting caught in the rotating parts and pulling them into the equipment. This shield, required by American Society of Agricultural Engineers (ASAE) S203.13 Sect. 4.6 DEC99, requires a tractor PTO shield which would conform to ANSI/ASAE S318.
