North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: Ref: ANSI (B30.6 -1969 Para: 5-3.1.2 a)hit by falling derrick - operator had not passed a practical operating examination. Ref: ANSI (B30.6-1969 Para 6-3.1.2 One feasible and acceptable method of abatement is to comply with ANSI (B30.6 - 1969 paragraph 6-3.1.2 b)hit by falling derrick - employee operating a 11,500 pound derrick with no boom angle indicator provided. Ref: 29 CFR 1926.550 (g)(3)(ii)(A) One feasible and acceptable method of abatement is to install a boom angle indicator. c)hit by falling derrick - employee operating a 11,500 pound derrick with no boom length indicator provided. Ref: 29 CFR 1926.550 (g)(3)(ii)(B) One feasible and acceptable method of abatement is to install a boom length indicator. d)fall from height - employees were being hoisted 120 feet into the air in a personal basket that had not been designed by a qualified engineer.
