North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to falls to a lower level: a)site-employee working in a platform from the forks of an all terrain forklift was not protected from falling or being bucked out of the basket by personal fall protection or restraining devices such as a positioning belt as required by para 5.15.1(k), ASME B56.6-1992.
