Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to suspected anthrax hazards: a) U.S. Postal Service Newark Facility (Cancellation Unit Area): Upon identifying a suspicious letter which was leaking an unknown powdery substance, the employer failed to follow established procedures designed to minimize the spread of suspect powders and potential employee exposure. Violation observed on or about 11/20/01. "Among other methods, one feasible and acceptable abatement method to minimize this hazard is to follow the established U.S. Postal Service policy on handling anthrax related emergencies (i.e., "USPSNEWSTALK response decision trees, administrative issues and other guidance on safety").
