Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall and struck by hazards: a.On or about July 22, 2002, a temporary employee sustained fatal injuries when he fell from a rear-end loaded refuse collection truck. The employer had not provided training for temporary employees regarding safe procedures to follow when riding on the truck and temporary employees had not been trained on the employer's health and safety rules, safe work practices, refuse collection procedures, and use of personal protective equipment. Among other feasible and acceptable methods to correct this hazard would be to implement a training program to thoroughly train temporary employees on safety procedures and safe work practices to be followed while collecting refuse.
