Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to the hazard of being struck or crushed due to equipment failure of the Drott 1800 Crane: a) Drott 1800 (Serial Number 106) involved in the accident at Highway 98 South, Lakeland FL. (near Lakeland Senior High School), on or about July 5, 2001. Employer did not ensure that a torque inspection was performed of the Drott 1800 turntable capscrews. Feasible abatement means would be complying with American National Standards Institute (ANSI) Standard B30.5-1968, Safety Standard for Cranes, Derricks, Hoists, Jacks and Slings, Section 5-2.3.1 (a), requiring a preventive maintenance program based on the crane manufacturers recommendations-including dated, detailed, and readily available records. This preventive maintenance program would also satisfy the requirements as outlined in ANSI B30.5- 1968 (previously mentioned), Section 5-2.1.3 (a)2 Periodic Inspection-loose bolts. In this particular case, torque for the turntable capscrews should have been inspected monthly or every 250 hours, as per both the Drott 1800 Operators Manual and the Service Manual. OR in the alternative, 29CFR1926.550(b)(2) Crawler, truck, or locomotive cranes did not meet the applicable requirements for preventive maintenance and inspection, as prescribed in the American National Standards Institute (ANSI) B30.5-1968, Safety Code for Crawler, Locomotive and Truck Cranes. a) For employee operating the Drott 1800 (Serial Number 106) on or about July 5, 2001 at Highway 98 South, Lakeland FL. (near Lakeland Senior High School).
